Terms of Service

1. Acceptance of Terms

By accessing or using the miMesa platform (mimesa.ch and app.mimesa.ch), operated by Lopes2tech ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use our services.

2. Description of Service

miMesa is a restaurant reservation management platform that provides tools for online bookings, table management, guest CRM, waitlist management, and analytics. The service is offered as a Software-as-a-Service (SaaS) solution.

3. Account Registration

To use miMesa, you must create an account and provide accurate, complete information. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access
• Ensuring all information provided is accurate and up to date

4. Acceptable Use

You agree to use miMesa only for lawful purposes and in accordance with these terms. You may not:

• Use the service for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to our systems or other users' accounts
• Interfere with or disrupt the service or servers
• Upload malicious code, viruses, or harmful content
• Resell, redistribute, or sublicense the service without permission
• Use automated systems to access the service without our consent

5. Pricing and Payment

miMesa offers multiple pricing plans as displayed on our pricing page. Prices are in CHF (Swiss Francs) and exclude applicable taxes (VAT).

Subscription fees are billed monthly in advance. You may upgrade, downgrade, or cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.

We reserve the right to modify our pricing with 30 days' advance notice.

6. Data Ownership

You retain full ownership of all data you input into miMesa, including guest information, reservation data, and restaurant configuration. We do not claim any ownership rights over your data.

You grant us a limited license to process your data solely for the purpose of providing and improving our services.

7. Service Availability

We strive to maintain 99.9% uptime for our services. However, we do not guarantee uninterrupted access and are not liable for temporary unavailability due to:

Scheduled maintenance (with advance notice), force majeure events, third-party service disruptions, or circumstances beyond our reasonable control.

8. Intellectual Property

The miMesa platform, including its design, code, features, and branding, is the intellectual property of Lopes2tech. You may not copy, modify, or reverse-engineer any part of the service.

Your use of miMesa does not grant you any intellectual property rights in the service beyond the right to use it according to these terms.

9. Limitation of Liability

To the maximum extent permitted by Swiss law, Lopes2tech shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service.

Our total liability for any claim arising from these terms shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Termination

Either party may terminate this agreement at any time. Upon termination:

Your access to the service will be revoked at the end of your current billing period. You may export your data before termination. We will delete your data within 30 days of termination, unless retention is required by law.

11. Governing Law

These terms are governed by the laws of Switzerland. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of the Canton of Zurich, Switzerland.

12. Changes to Terms

We may modify these terms from time to time. Material changes will be communicated via email or through the platform with at least 30 days' notice. Continued use of the service after changes take effect constitutes acceptance of the updated terms.
